General Terms and Conditions for paani.ch - a division of PPS Sportsgoods AG

1. area of application
These general terms and conditions are valid for all orders, which customers place via the online store paani.ch, Hinterbergstrasse 24, 6312 Steinhausen, phone: +41 41 783 83 88, info@paani.ch (hereafter PAANI).

2. registration
2.1 Shopping at PAANI is only allowed for customers, who have registered properly and truthfully.

2.2 The creation of multiple accounts and their use by the same person is strictly prohibited.

2.3 In addition, any commercial or industrial use for the purpose of reselling goods to third parties is prohibited.

2.4 Violations may result in immediate exclusion and claims for damages by PAANI. PAANI can also limit the maximum delivery quantity per article and customer.

3. Conclusion of Contract
3.1 The presentation of the products in the online store is not a legally binding offer, but an invitation to order.

3.2 By clicking the button "Submit Order" in the shopping cart, the customer submits a binding offer.

3.3 The automatically generated confirmation e-mail documents the receipt of the order. The binding contractual relationship is only concluded when PAANI confirms the shipment of the goods by e-mail (shipment confirmation) but at the latest when the goods are delivered.

3.4 If PAANI discovers during the processing of the order that the products ordered by the customer are not available, the customer will be informed by e-mail. A contract about the unavailable goods is not concluded.

4. Prices and Shipping Costs
4.1 The prices listed in the PAANI Online Shop at the time of the order are valid. The prices listed are net prices including the statutory value added tax and are in Swiss francs (CHF).

4.2 Deliveries are made free of shipping costs by post or DHL courier.

5. Terms of delivery
5.1 Delivery is made within Switzerland/Liechtenstein.

5.2 Goods in stock are usually ready for immediate shipment.

5.3 In the event that an order does not arrive at the customer on a requested or communicated delivery date, however, claims for damages are excluded.

5.4 If the delivery of the goods fails due to the fault of the customer, PAANI can withdraw from the contract. Any payments made will be refunded immediately.

6. Terms of Payment
6.1 Payment can be made by credit card, PostFinance (PostCard), PayPal, cell phone payment or on account. All payments are processed via Shopify Payments. The data is transmitted encrypted for processing.

6.2 PAANI can cancel an order if
(a) a customer is not creditworthy or seems.
(b) reasonable suspicion of dishonest intentions.

6.3 Purchase by invoice with partial payment option (POWERPAY)

As an external payment provider, MF Group/POWERPAY offers the payment option ‘Pay by invoice’. You can simply pay for your online purchase by invoice using the order invoice. If you do not make the payment within the specified period, you will receive a subsequent monthly invoice the following month with an order overview.

When a purchase agreement is made, POWERPAY takes on the amount receivable and processes it using the payment method selected. By selecting purchase by invoice, you are also agreeing to our AGB, POWERPAY’s AGB. (powerpay.ch/en/agb).

7. Returns
7.1 Returnable items can be sent back to PAANI within 30 days from the invoice date. The goods must be returned new, unworn, unwashed and in their original condition including label(s) and original packaging, as well as the return bill. The costs for the return are borne by the customer.

7.2 The right of return is excluded for the following products:
- Underwear
- Items with the note "this item cannot be returned"

If the above mentioned products are defective, incomplete or in bad condition, they can also be returned. In this case PAANI will try to find an equivalent replacement. If this is not possible, the money already paid will be refunded.

7.3 Orders that have already been paid in advance by credit card will be refunded to the credit card.

8. Retention of Title
Until full payment has been made, the goods remain the property of PAANI.

9. Redemption of Promotion Vouchers

9.1 The promotional vouchers are redeemable only from the minimum order value indicated on the voucher.

9.2 Accumulation of several promotional vouchers is not permitted.

9.3 The promotional vouchers are valid until the specified date.

9.4 It is not permitted to transfer promotion vouchers to third parties.

9.5 The promotional vouchers cannot be subsequently credited to an order.

9.6 The balance of a promotion voucher can neither be paid out in cash nor can
be charged interest.

10. Redeeming purchased gift vouchers
10.1 The gift voucher is transferable. Duplication or alteration of the gift vouchers is not permitted.

10.2 Gift vouchers cannot be subsequently credited to an order.

10.3 The credit balance of a Gift Voucher cannot be paid out in cash nor can interest be paid on it.

11. Data protection
The data protection declaration applies to the processing of personal data by PAANI.

12. Changes to the General Terms and Conditions
These General Terms and Conditions may change. We list in each case the date of the last changes.
